OBTAINING AN EB-5 VISA IN 5 STEPS

Regional Center experts will guide you through each step

1. Engage an Immigration Attorney
You will work with an experienced U.S. immigration attorney to discuss your immigration strategy and prepare the documentation required to demonstrate the lawful source of your investment funds. Your attorney will review your documents, prepare your EB-5 petition, and file it with U.S. Citizenship and Immigration Services (USCIS).
2. Select a Project
With the assistance of a USCIS-designated Regional Center, you will be able to review available EB-5 investment opportunities, select an investment project, and complete the required subscription documentation.
3. File the I-526E Petition
After selecting an EB-5 investment project, making or actively proceeding with the required investment, and providing the necessary supporting documentation, your immigration attorney will prepare and file Form I-526E, Immigrant Petition by Regional Center Investor, with U.S. Citizenship and Immigration Services (USCIS). If you are in the United States and otherwise eligible, you may also be able to file Form I-485 to apply for adjustment of status when an immigrant visa is immediately available.
4. Obtain Your Conditional Green Card
After approval of the I-526E petition and when an immigrant visa is available, your immigration attorney will assist you with the consular processing stage, including preparation of the required immigrant visa application and supporting documentation and preparation for the visa interview. After receiving your immigrant visa and entering the United States, you become a conditional permanent resident for a two-year period.
5. Receive Your Permanent Green Card
Your immigration attorney will file Form I-829 during the 90-day period before the second anniversary of obtaining conditional permanent resident status. The petition must demonstrate compliance with applicable EB-5 investment and job creation requirements. Upon approval, the conditions on your and your eligible family members’ permanent resident status are removed. A standard Green Card is generally valid for 10 years.
FREQUENTLY ASKED QUESTIONS
Your Connection with a Regional Center
After we connect you with an experienced USCIS-designated Regional Center, you will be able to discuss all your questions and concerns about the EB-5 process, your immigration objectives and individual circumstances, available investment opportunities, project requirements, expected timelines, and the next steps in the process.
Submission of Initial Documents:
From as little as 2 weeks to several months, depending on the complexity of your case and the time required to collect the necessary source-of-funds and other supporting documentation and provide it to your immigration attorney.
Adjudication of Your I-526E Petition:
Approximately 6 to 18 months for many cases, although processing times vary significantly depending on the EB-5 category and individual case circumstances, and some petitions may take considerably longer.
Conditional Green Card:
Approximately 6 to 12 months after I-526E petition approval, depending on visa availability, NVC processing, and consular interview scheduling.
Filing I-829 Petition for a Permanent Green Card:
Approximately 21 to 24 months after obtaining your Conditional Green Card, Form I-829 is generally filed during the 90-day period immediately before the second anniversary of obtaining conditional permanent resident status to remove the conditions on that status.
Obtaining the Permanent Green Card:
Approximately 6 to 24 months after filing Form I-829, although processing times may vary. Upon approval, the conditions on your permanent resident status are removed.
Investment Return ($800,000):
After the applicable investment period, return of capital may be possible subject to the terms and performance of the specific EB-5 investment. Under current USCIS policy for post-RIA investors, qualifying capital must generally remain invested and at risk for at least two years. In practice, EB-5 project investment periods often range from approximately 3 to 5 years. Return of the investment is not guaranteed.
Filing for U.S. Citizenship:
Generally, 5 years after obtaining conditional permanent resident status (Conditional Green Card), subject to applicable naturalization requirements. I-829 approval is generally required before naturalization can be approved.
What Qualifies for an EB-5 Investment?
An eligible EB-5 investment is a qualifying investment in a new commercial enterprise that meets applicable EB-5 requirements, including job creation requirements. For Regional Center investments, the investment is typically made through an entity such as an LLC or LP associated with an approved EB-5 project. Simply purchasing personal or commercial real estate does not by itself qualify as an EB-5 investment.
Are There Guarantees for Investment Return?
No. EB-5 investments must remain at risk, and return of the invested capital cannot be guaranteed. Choosing an experienced USCIS-designated Regional Center with an established track record can be an important factor in managing risks throughout your immigration and investment process. We can connect you with such a Regional Center.
How Soon Will I Receive My Investment Back?
The timing of any return of your investment depends on the terms and performance of the specific EB-5 project. In practice, EB-5 project investment periods often range from approximately 3 to 5 years.
Can the Investment Be Insured?
An EB-5 investment itself cannot include a guarantee against the loss or return of the invested capital, as the investment must remain “at risk” under EB-5 requirements. Certain independent third-party insurance or indemnity arrangements may be permissible, provided they do not constitute a guaranteed repayment, redemption, or buy-back arrangement. An experienced USCIS-designated Regional Center can provide information about the structure, terms, and risk considerations of its specific EB-5 investment projects. Any insurance or indemnity arrangement should be evaluated on a case-by-case basis.
Do I Have to Live Where I Invest?
No. EB-5 investors are not required to live in the same state or area where their Regional Center investment project is located. Once admitted as a lawful permanent resident, you may generally live, work, or study anywhere in the United States. An experienced Regional Center can also provide practical information and guidance to help you better understand the relocation process and your options in the United States.
Can a Third Party Invest on My Behalf?
Yes. Third-party funds, including gifts or loans, may be used for your EB-5 investment, but you remain the EB-5 investor. The lawful source and path of the funds, including appropriate documentation regarding the donor or lender, must be properly documented. Your immigration attorney can advise you on the evidence required for your individual case.
Can I use a Loan to Finance My EB-5 Investment?
Yes. Loan proceeds may be used for an EB-5 investment, provided the funds are lawfully obtained and properly documented. The lawful source and path of the funds must be demonstrated, and the investment must satisfy applicable EB-5 “at-risk” requirements.
Can You Provide Support in Other Languages?
The EB-5 professionals we can connect you with speak English, Spanish, Russian, Portuguese, Turkish, Vietnamese, Simplified Chinese, Traditional Chinese, and Korean. We take your communication preferences into account and can connect you with an experienced professional who speaks your preferred language.
